Terms of Service

1. Service

ZaKul AI provides tools for AI-assisted music generation, audio processing, storage, editing and export. AI-generated results may vary and are not guaranteed to be unique, error-free or suitable for a particular commercial purpose.

2. Eligibility and accounts

You must be at least 18 years old or have permission from a parent or legal guardian. You are responsible for your account, login credentials and all activity performed through it.

3. Subscriptions and points

Creator and Pro are recurring monthly subscriptions. Prices, currency, taxes and the renewal date are shown before payment. Paddle acts as Merchant of Record and processes payments, taxes, invoices, renewals and refunds. Unless canceled, subscriptions renew automatically. Unused monthly points do not roll over.

You may cancel at any time. Cancellation prevents the next renewal; paid access normally continues until the end of the current billing period.

4. User content

You may upload or process only lyrics, recordings, voices, samples and other materials that you own or are authorized to use. You are responsible for obtaining all required permissions, including consent from identifiable voice owners and performers.

5. Generated content and licenses

Basic-plan outputs are licensed for personal, non-commercial use. Creator and Pro outputs may be used commercially while the relevant plan and license terms apply. ZaKul can grant only rights it owns or is authorized to grant. No guarantee is made that an output is copyrightable, exclusive, or free from similarity to third-party works.

6. Prohibited use

You must not use ZaKul to infringe intellectual-property or privacy rights, impersonate others deceptively, distribute unlawful or abusive material, bypass security or usage limits, resell accounts, or interfere with the service.

7. Availability

We may update models, features and limits and may temporarily suspend the service for maintenance, security or infrastructure reasons. We do not guarantee uninterrupted availability.

8. Suspension and termination

We may restrict or terminate accounts involved in fraud, unlawful activity, chargebacks, security abuse or material violations of these terms. Users may stop using the service and cancel their subscriptions at any time.

9. Liability

To the maximum extent permitted by law, ZaKul is not liable for indirect or consequential losses, loss of profits, loss of data, or claims arising from user-provided materials. Mandatory consumer rights remain unaffected.

10. Governing terms

These terms are governed by the laws of Ukraine, without limiting mandatory consumer protections applicable in your country. Purchases are also subject to the Paddle Buyer Terms.

Privacy Notice

1. Controller

The controller for ZaKul account and service data is Kulyk Vitalii Dmytrovych, Ukraine. Contact: [email protected].

2. Data we process

We may process your name, email address, authentication records, subscription status, points balance, prompts, lyrics, generated tracks, uploaded audio, projects, support messages, IP address, device information, security logs and service-usage records.

3. Purposes and legal bases

Data is processed to provide accounts and music services, perform contracts, secure the platform, prevent fraud, provide support, meet legal obligations and improve reliability. Where required, we rely on consent for optional processing.

4. Service providers

We use providers including Paddle for billing, Google for optional authentication, Hetzner for hosting, Cloudflare for network security and delivery, and RunPod or related infrastructure for AI processing. These providers process data under their own terms and applicable data-processing obligations.

5. Payments

Paddle is Merchant of Record. ZaKul does not receive or store full payment-card details. Paddle may process billing identity, payment, tax, fraud-prevention and transaction information.

6. International transfers

Providers may process data in different countries. Appropriate contractual, technical or legal safeguards are used where required.

7. Retention

Account and content data is retained while your account is active and afterward only as reasonably necessary for legal, security, backup and dispute-resolution purposes. Billing records may be retained by Paddle as required by tax and financial laws.

8. Your rights

Depending on your location, you may request access, correction, deletion, restriction, portability or objection, and may withdraw consent where processing is based on consent. Contact [email protected]. You may also complain to your competent data-protection authority.

9. Security and children

We use access controls, encryption in transit, restricted server permissions and operational safeguards. No system is completely secure. ZaKul is not intended for children under 13.

Refund Policy

1. Cancellation

You may cancel a subscription at any time. Cancellation stops the next automatic renewal and does not normally create a refund for the current billing period.

2. Refund requests

Refund requests should be submitted promptly, preferably within 14 days of the relevant charge, to [email protected] or through Paddle buyer support. Include the purchase email and transaction details, but never send full card information.

3. Eligibility

Refunds may be issued for duplicate charges, unauthorized transactions, material technical failure, or where required by applicable consumer law. For discretionary requests, usage of subscription benefits, points and generated content may be considered.

4. Renewals

Subscription renewals are generally non-refundable after the new billing period begins, except where required by law or approved following review. Cancel before the displayed renewal date to avoid the next charge.

5. Processing

Paddle, as Merchant of Record, processes approved refunds to the original payment method. Bank processing times vary. This policy does not limit mandatory statutory cancellation or refund rights.
